This essay argues that ideals of cooperation or adversariality in argumentation are not equally attainable for women. Women in argumentation contexts face oppressive limitations undermining argument success because their authority is undermined by gendered norms of politeness. Women endorsing or, alternatively, transgressing feminine norms of politeness typically defend their authority in argumentation contexts. And yet, defending authority renders it less legitimate. My argument focuses on women in philosophy but bears the implication that other masculine dis- course contexts present similar double (...) binds that urge social and political change. (shrink)

Cancer treatment decisions should be based on all available evidence. But this evidence is complex and varied: it includes not only the patient’s symptoms and expert knowledge of the relevant causal processes, but also clinical databases relating to past patients, databases of observations made at the molecular level, and evidence encapsulated in scientific papers and medical informatics systems. Objective Bayesian nets offer a principled path to knowledge integration, and we show in this chapter how they can be applied to integrate (...) various kinds of evidence in the cancer domain. This is important from the systems biology perspective, which needs to integrate data that concern different levels of analysis, and is also important from the point of view of medical informatics. Suppose one hundred prisoners are in a yard under the supervision of a guard, and at some point, ninety-nine of them collectively kill the guard. If, after the fact, a prisoner is picked at random and tried, the probability of his guilt is 99%. But despite the high probability, the statistical chances, by themselves, seem insufficient to justify a conviction. The question is why. Two arguments are offered. The first, decision-theoretic argument shows that a conviction solely based on the statistics (...) in the prisoner scenario is unacceptable so long as the goal of expected utility maximization is combined with fairness constraints. The second, risk-based argument shows that a conviction solely based on the statistics in the prisoner scenario lets the risk of mistaken conviction surge potentially too high. The same, by contrast, cannot be said of convictions solely based on DNA evidence or eyewitness testimony. A noteworthy feature of the two arguments in the paper is that they are not confined to criminal trials and can in fact be extended to civil trials. (shrink)

Although there are notable exceptions, examination of nursing's participation in colonizing processes and practices has not taken hold in nursing's consciousness or political agenda. Critical analyses, based on the examination of politics and power of the structural determinants of health, continue to be marginalized in the profession. The goals of this discussion article are to underscore the urgent need to further articulate postcolonial theory in nursing and to contribute to nursing knowledge about paths to work toward decolonizing the profession. The (...) authors begin with a description of unifying themes in postcolonial theory, with an emphasis on colonized subjectivities and imperialism; the application of a critical social science perspective, including postcolonial feminist theory; and the project of working toward decolonization. This paper argues that we ought to distinguish between ‘assisted’ gestation and ‘delegating’ gestation—and that the relevant difference does not depend on whether it is another human or technological system doing the work.1 In the philosophy of action, there is an important theoretical gap between S ‘helping A to φ’ and S ‘φ-ing on behalf of A’: the former is an instance of joint agency while the latter is an individual’s action. This matters because if the latter counts as an (...) intentional action, then only S is being said to have acted intentionally while, if the former is an intentional action, then both S and A have acted intentionally—which might have consequences for responsibility attributions, for example. To put it brutally, it is the difference between Belarus supporting Putin’s invasion and Belarus doing Putin’s dirty work—and you do not have to be a Russian mother to see that these two alternatives will have very different consequences. In another context, the economics of outsourcing is also built around the same theoretical distinction. But does this matter to gestation and reproduction? It does, argues this paper. Insisting on an ‘assisted’ reproduction framework2–8 reinforces patriarchal stereotypes and continues to put undue burdens on prospective mothers both by perpetuating the stereotype of women as needing help and also by implicating them in an action that might genuinely not be theirs. Delegation, on the other hand, empowers parents—who are in charge, rather than needing help. The ethical issues associated with germline gene modification and embryo research are some of the most contentious in current international science policy debates. In this paper, we argue that new genetic techniques, such as CRISPR, demonstrate that there is an urgent need for China to develop its own regulatory and ethical framework governing new developments in genetic and embryo research. While China has in place a regulatory framework, it needs to be strengthened to include better compliance oversight and explicit criteria (...) for how different types of research should be reviewed by regulatory authorities. We also document a variety of opinions about the new technologies among the public, scholars, and policy makers. China needs to develop its own regulations in coordination with other countries; but it is unlikely that an international consensus will be achieved in this area, given the existing differences in regulations between countries. We should aim at harmonization, not necessarily complete consensus, and the perspective from China is vital when international norms are developed and harmonized. Chinese policy makers and researchers need to be aware of the international discussions, at the same time as the international community is aware of, and accommodates, Chinese positions on important policy options. Based on person-environment fit theory, this study examined the effects of empowering leadership on employee work engagement. We also investigated the mediating mechanism of person-job fit and person-group fit. In addition, we explored employee proactive personality's moderating role between empowering leadership and the above two kinds of fit, and then the set of indirect effects. Using a survey sample of 6179 employees from a technology company in China, we found that empowering leadership has a positively indirect influence on employees work (...) engagement though person-job fit and person-group fit. Further, moderated mediation analysis revealed proactive personality augmented empowering leadership direct effect on person-job fit and person-group fit and indirect effect on work engagement. I argue that chimericity is a property that we typically experience when listening to multi-instrumental music. It is the property of hearing as a unified whole a melody or a harmony that does not belong to any single sound source but instead consists of the assembling of melodic or harmonic fragments coming from different sources. Chimericity is not reducible to the low-level audible properties of pitch and loudness; it is cognized at the perceptual level thanks to the auditory mechanism of (...) primitive grouping. My aim is to show that chimericity is a perceptual property, one that we can genuinely hear. In developing this view, I engage with the debate within the philosophy of sense perception between rich vs thin views of the content of perceptual experience. (shrink)

The aim of this paper is to examine whether and, if so, how far, the Augustinian notion of pulchrum is related to Plotinus’ concept of beauty, as it appears in Ennead I. 6. The Augustinian notion of beauty will be analyzed by focusing on the De natura boni, considering plurality and unity in Augustine’s identification of bonum with esse, both in their ontological and axiological dimensions. Topics selected for special consideration will be, first, beauty as outcome of modus, species and (...) ordo naturalis, and, secondly, corruptio as cause of deformitas. The first part of the paper will attempt to explain the Augustinian identification of esse with bonum and pulchrum.The second part will analyze Plotinus’ notion of beauty, as spelled out in Ennead I. 6, considering the Plotinian identity of to kalon and to agathon. Topics selected for analysis will be, first, the concept of form as cause of beauty, and secondly, the notion of to aischron as partial or absolute lack of form. The second part of the paper will attempt to explain Plotinus’ concept of good as yielding the nature of beauty through an analysis of Plotinus’ reflections on being and unity. The third part of this paper will consider the differences between Plotinus’ and Augustine’s identity of ugliness and non-being, as related to the notion of matter. Topics selected for analysis will be, firstly, Plotinus’ identity of matter and to aischron, and, secondly, Augustine’s concept of matter as capacitas formarum. The conclusion will prove how Plotinus’ concept of matter as coinciding with ugliness shows a wide theoretical difference between Augustine’s and Plotinus’ ontological-axiological patterns. (shrink)

Hannah Arendt has a particular notion of thinking that both is and is not philosophical. While not guided by the search for meta principles, nor concerned with establishing logical systems, her notion of thinking as the examination of “whatever happens to come to pass,” and its significance for saving our world from thoughtlessness, retains and is motivated by the fundamental pathos at the heart of philosophy—wonder. In this paper, I consider the limiting and enabling sense in which Arendt invokes “wonder” (...) for the possibility of thinking. I do so, in turn, to explore what the pathos of wonderment might offer education—an institution charged with cultivating “thinking” and, yet, constantly susceptible to the thoughtless trappings of technocratic jargon and the mechanical logic of assessment, learning processes and social reproduction. Can wonder—the very pathos of philosophy—cultivate a thinking that helps us retain an “unclouded attentiveness” to what is educational in education? Might wonder help us to overcome the thoughtlessness that dulls our attention to what we do to each other through education? (shrink)

Background: Personal genomic testing (PGT) offers individuals genetic information about relationships, wellness, sporting ability, and health. PGT is increasingly accessible online, including in emerging markets such as Australia. Little is known about what consumers expect from these tests and whether their reflections on testing resonate with bioethics concepts such as autonomy. Methods: We report findings from focus groups and semi-structured interviews that explored attitudes to and experiences of PGT. Focus group participants had little experience with PGT, while interview participants had (...) undergone testing. Recordings were transcribed and analyzed using thematic analysis. Findings were critically interpreted with reference to bioethics scholarship on autonomy. Results: Fifty-six members of the public participated in seven focus groups, and 40 individuals were interviewed separately. Both groups valued the choice of PGT, and believed that it could motivate relevant actions. Focus group themes centered on the perceived value of choices, knowledge enabling action and knowledge about the self. Interview themes suggest that participants reflexively engage with their PGT information to make meaning, and that some appreciate its shortcomings. Critical interpretation of findings shows that while consumers of PGT are able to exercise a degree of autonomy in choosing, they may not be able to achieve a substantive conceptualization of autonomy, one that promotes alignment with higher-order desires. Conclusions: PGT consumers can critically reason about testing. However, they may uncritically accept test results, may not appreciate drawbacks of increased choice, or may overestimate the potential for information to motivate behavioral change. While consumers appear to be capable of substantive autonomy, they do so without ongoing support from companies. PGT companies promote a problematic (“default”) account of autonomy, reliant on empowerment rhetoric. This leaves consumers vulnerable to making decisions inconsistent with their higher-order desires. As PGT expands, claims about its power and value need to be carefully drawn. (shrink)

In an essay titled Aquinas on the Foundations of Knowledge, Eleonore Stump rejects the idea that Aquinas's epistemology is foundationalist. I agree with Stump, and share in her conviction that the Angelic doctor developed instead what can be seen as a kind of theological reliabilism. In this article, I intend to take her position a step further. First, I would like to show that Thomistic reliabilism falls into a vicious circle if seen as based on a merely rational theism. I am going to argue that for Aquinas such reliabilism depends instead on Christian faith, construed as the act of believing the revealed truth by virtue of the love relationship that God allows human beings to have with him. The primary aim of this chapter is to explain the nature of evidential reasoning, the characteristic difficulties encountered, and the tools to address these difficulties. Our focus is on evidential reasoning in criminal cases. There is an extensive scholarly literature on these topics, and it is a secondary aim of the chapter to provide readers the means to find their way in historical and ongoing debates.

Workplace Incivility (WI) occurs worldwide and has negative consequences on individuals and organizations. Valid and comprehensive instruments have been used, specifically in English speaking countries, to measure such adverse process at work, but it is not available a validated instrument for research carried out in Spanish speaking countries. In this study we aim to test the psychometric properties of the Matthews and Ritter’s four-item Workplace Incivility Scale (2016) with Spanish workers (N= 407) from different sectors. Participants’ mean age was 38.73 (...) (SD= 10.45) years old and the percentage of female employees was 59.2%. Confirmatory factor analysis using AMOS 19.0 was carried out, presenting a good fit. The internal consistency, convergent and concurrent validity of the scale were examined. Results show good scale reliability and expected high correlations with social undermining. Moreover, the scale related to propensity to leave a job, job satisfaction, and psychological well-being in the expected way. After configural invariance across groups was established, testing for metric invariance and scalar invariance was performed. Considering Δχ² and ΔCFI tests for two nested models, the 4-item scale was invariant when the employment status is considered (permanent vs temporal, full-time vs part-time and supervisor vs non supervisors). Overall, our findings showed good psychometric properties of the shorter version of the Workplace Incivility Scale in Spain. Theoretical and practical implications of this study are discussed. Is the wish to be biologically related to your children legitimate? Here, I respond to an argument in support of a negative answer to this question according to which a preference towards having children one is biologically related to is analogous to a preference towards associating with members of one’s own race. I reject this analogy, mainly on the grounds that only the latter constitutes discrimination; still, I conclude that indeed a preference towards children one is biologically related to is (...) morally illegitimate because, in the context of parental love, biological considerations are normatively irrelevant. In two recent articles, Travis Dumsday has formulated a response to the problem of divine hiddenness on the basis of the Christian doctrine—especially Aquinas’s thought. I agree with Dumsday that Christians qua Christians can significantly contribute to the debate in question. However, in both articles the author overlooks a decisive aspect of Aquinas’s doctrine of faith and the Christian teachings that trace back to it. This article dwells on Dumsday’s interpretation of Aquinas’s thought, and from within my argument proposes a (...) different response to the problem of divine hiddenness. (shrink)

The theologians of the late German Enlightenment saw in Kant's Critique of Pure Reason a new rational defence of their Christian faith. In fact, Kant's critical theory of meaning and moral law totally subverted the spirit of that faith. This challenging new study examines the contribution made by the Critique of Pure Reason to this change of meaning. George di Giovanni stresses the revolutionary character of Kant's critical thought but also reveals how this thought was being held hostage to unwarranted (...) metaphysical assumptions that caused much confusion and rendered the First Critique vulnerable to being reabsorbed into modes of thought typical of Enlightenment popular philosophy. Amongst the striking features of this book are nuanced interpretations of Jacobi and Reinhold, a lucid exposition of Fichte's early thought, and a rare, detailed account of Enlightenment popular philosophy. Aristóteles comparte con Platón la concepción de la forma como causa del ser y del conocimiento de las cosas. Sin embargo, un análisis de sus críticas a las Ideas muestra que encuentra en la separación de las Ideas y las cosas sensibles la aporía fundamental de la teoría platónica. Con el propósito de circunscribir el significado de “separación” aplicable a las Ideas, concentraremos nuestro estudio en dos objeciones: 1) el argumento que conduce al tercer hombre y 2) la inutilidad de (...) las Ideas como causas. En el primer caso, creemos que la separación entraña homonimia, por lo que la solución aristotélica implicará la comunidad de naturaleza entre el individuo y su esencia. En el segundo, la separación implica trascendencia o falta de contacto entre generante y generado, por lo que la solución aristotélica apuntará a concebir la forma de las entidades naturales como un principio inmanente, inseparable de la materia y del movimiento, pero a la vez eterno a través de su reproducción en otros individuos de la misma especie. Creemos que en ambas soluciones opera un principio de sinonimia, que constituye su propia contribución al problema de la separación. (shrink)

Il multiculturalismo è un modello culturale e politico-istituzionale per la gestione della diversità in una società multietnica, la cui base teorica viene dal relativismo culturale. Come nessuna cultura può pretendere una validità universale, il processo di storicizzazione della razionalità occidentale segna la fine della pretesa metafisica di dire la verità dell’uomo e del mondo, nononstante si crede che il fare della scienza è l’accadere della verità. Nel gestire la diversità e nell’assicurare la tolleranza risiede la «necessità» del multiculturalismo. Sua debolezza (...) teorica risiede paradossalmente nell’incapacità di pensare la differenza. Universale non è la cultura, che è sempre particolare, ma l’ umano . Solo l’affermazione di questa dimensione universale dell’esperienza può fondare il rispetto della singolarità dell’altro, di sua infinita alterità e differenza. L’umano si dice sempre in una cultura determinata. La struttura universale dell’esperienza è al tempo stesso in e al di là di ogni cultura, insieme trascendente e immanente, trans-immanente . Questa identità strutturale è costitutivamente assegnata a una emergenza molteplice. In questo contesto, si può parlare di una ragione che, in nome di una fedeltà all’esperienza, si dispone a ripensare il problema dell’universalità, il rapporto tra il singolare e l’universale. A necessidade do multiculturalismo reside no administrar a diversidade e no assegurar a tolerância. Sua fraqueza teórica se encontra paradoxalmente na incapacidade de pensar a própria diferença. Universal não é a cultura, que é sempre particular, mas o humano . Somente a afirmação desta dimensão universal da experiência pode fundar o respeito da singularidade do outro, de sua infinita alteridade e diferença. O humano se diz sempre numa cultura determinada. A estrutura universal da experiência está, ao mesmo tempo, em e além de cada cultura, ao mesmo tempo transcendente e imanente, trans-imanente . Esta identidade estrutural é constitutivamente assinalada a uma experiência múltipla. Nesse contexto, pode-se falar de uma razão que, em nome da fidelidada à experiência, dispõe-se a repensar o problema da universalidade, a relação entre o singular e o universal. As no culture can claim to universal validity, the historicizing process of western rationality points out the end of metaphysical pretension of telling the truth about man and the world, although one believe that doing science is already the case for truth. The necessity of multiculturalism lies in managing diversity and in ensuring tolerance. Its theoretical weakness is paradoxically unable to think of difference itself. Culture always emerges as being the particular as the human appears as being the universal. Only the statement of this universal dimension of experience can establish the respect of other's uniqueness, of his infinite otherness and difference. The human is always understood within a specific culture. The universal structure of experience is at the same time, in and beyond each culture in particular, at the same time immanent and transcendent, there is to say, trans-immanent. This structural identity is constitutively marked by a multiple experience. In this context, one can speak of a reason that in the name of fidelity to experience is willing to rethink the problem of universality, the relationship between the singular and universal.
